Minutes for June 21, 2010

The pledge of allegiance was conducted and the scheduled June 21, 2010 Council meeting was called to order by President Rodgers at 7:00 p.m.

Present: Attorney Dan Lovette, Manager Richard Wargo, Sec. /Tres. Judith A. Czyrnik, Clerk-Amanda Claycomb, President Richard Rodgers, Council Members; Mr. Ed Danyluk, Mr. Herb Ewald, Mr. Kevin Pile, and Mr. Robert Morgan, Mayor Gregory Paolini, West Hills Police Chief Andy Havas

Absent: Council Member Mr. William Kory, Mr. Tom Strittmatter, Fire Chief Mike Leckey

Meeting Agenda

A motion was made by Mr. Pile to approve the Council Meeting Minutes of May 17, 2010. Motion seconded by Mr. Ewald. All in favor, motion carried. A motion was made by Mr. Pile to approve the Committee Meeting Minutes of June 8, 2010. Motion seconded by Mr. Ewald. All in favor, motion carried. A motion was made by Mr. Pile to approve the ratification of payroll for May 2010 in the amount of $21,719.10. Motion seconded by Mr. Danyluk. Role call: Mr. Rodgers, Mr. Danyluk, Mr. Ewald, Mr. Pile, Mr. Morgan in favor. Mr. Kory and Mr. Strittmatter absent. Motion carried (5-0). A motion was made to approve the bills for May 19 through June 22, 2010 in the amount of $58,760.40. Motion seconded by Mr. Danyluk. Role call: Mr. Rodgers, Mr. Danyluk, Mr. Ewald, Mr. Pile, Mr. Morgan in favor. Mr. Kory and Mr. Strittmatter absent. Motion carried (5-0).A motion was made by Mr. Ewald to approve the May 2010 treasurer’s report. Motion seconded by Mr. Morgan. All in favor, motion carried. A motion was made by Mr. Pile to note the receipt of the May 2010 tax collector’s report in the amount of $10,014.56. Motion seconded by Mr. Danyluk. All in favor, motion carried.

Police Chief’s Report

Chief Havas reported the West Hills Police Department participated in the Westmont Borough Memorial Day Program. Chief Havas noted various walks and runs have taken place in the West Hills area recently and on-duty officers have assisted the sponsors with traffic control and safety concerns for these activities.

Fire Company’s Report

Chief Leckey absent. The Hilltop Ambulance Report was received and is on file.

Engineer’s Report

Mr. Wargo reported the State Street Project is scheduled to begin June 21, 2010.

Zoning Officer’s Report

Mr. Wargo reported five Building Permits issued and four approved Sewer Compliances. Mr. Wargo stated information required to obtain 12 Harding Street under the Abandoned and Blighted Properties Act is being obtained and will be provided to Solicitor Lovette.

Mayor’s Report

Nothing to report.

Manager’s Report

Mr. Wargo reported an inspection of the levee has been completed and went well. Mr. Wargo stated the Stoneycreek Watershed Ordinance mandated by the Department of Environmental Protection is being reviewed by Solicitor Lovette. A motion was made by Mr. Pile to continue the Stoneycreek Stormwater Management Plan. Motion seconded by Mr. Danyluk. All in favor, motion carried. Mr. Wargo reported the Harding Street Steps Grant has been completely closed out.

Solicitor’s Report

An Executive Session was called at 7:21 p.m. regarding legal matters. Council resumed its regularly scheduled meeting at 7:37 p.m. A motion was made by Mr. Pile to approve a commitment of up to $2,500.00 for paving the Ridge road contingent upon the school district and Upper Yoder also contributing up to $2,500.00. Motion seconded by Mr. Ewald. Role call: Mr. Rodgers, Mr. Danyluk, Mr. Ewald, Mr. Pile, Mr. Morgan in favor. Mr. Kory and Mr. Strittmatter absent. Motion carried (5-0).

Secretary’s Report

Ms. Czyrnik reported the Department of Labor and Industry will be closing out a workers compensation claim for Mr. Roy Livingston from a 1994 injury. A motion was made by Mr. Pile to approve Mr. Wargo and Mr. Jan Bosley’s attendance at a free Penn DOT Storm Water Management workshop on June 23, 2010. Motion seconded by Mr. Morgan. All in favor, motion carried.

1) COMMITTEE REPORTS

A. Streets: Nothing to report.

B. Administration: Nothing to report.

C. Personnel: Mr. Strittmatter absent. Nothing to report.

D. Police Committee: Nothing to report.

E. Budget & Tax Collection Committee: Nothing to report.

F. Shade Tree Committee: Mr. Morgan reported he is updating a tree inventory form. Mr. Morgan stated he would like to inventory all trees in Southmont Borough to keep track of trees being planted and removed.

G. Recreation Committee: Mr. Kory absent. Mr. Ewald reported roofing is being replaced at the Ridge pavilion. Mr. Ewald stated fireplaces at the Ridge are in deplorable conditions noting the Recreation Commission would like to request each municipality take on one fireplace to repair. Mr. Wargo will follow up with Mr. Ewald.

H. Buildings & Grounds Committee: Mr. Kory absent. Mr. Wargo reported the bird sanctuary fence is ongoing and a grant is being filed for the costs.

I. COG Report: Mr. Wargo reported COG will begin reflectivity testing for street signs noting the new required street signs will be installed as the old ones are replaced.

J. Greater Johnstown Water Authority: Mr. Pile reported the inter-connection with Ligonier is ongoing and the next meeting is June 22.

K. Open Records: Mr. Kory absent. One open records request was received for Ordinance Number 460 regarding animal nuisance.

There being no further business, a motion was made by Mr. Danyluk for adjournment of the June 21, 2010 meeting at 7:54 P.M. Motion seconded by Mr. Pile. All in favor, motion carried.
