Minutes for June 20, 2011
The pledge of allegiance was conducted and the scheduled June 20, 2011 Council meeting was called to order by President Rodgers at 7:00 p.m.
Present: Attorney Michael Carbonara, Manager Richard Wargo, Sec. /Tres. Judith A. Czyrnik, Asst. Sec./Tres. Amanda Claycomb, President Richard Rodgers, Council Members; Mr. Ed Danyluk, Mr. Herb Ewald, Mr. Kevin Pile, Mr. Tom Strittmatter and Mr. Robert Morgan Mayor Gregory Paolini, West Hills Police Chief Andrew Havas
Absent: Council Member Mr. William Kory (out of town), Fire Chief Mike Leckey, Engineer Scott Rughe (excused)
Meeting Agenda
A motion was made by Mr. Morgan
to approve the Council Meeting Minutes of April 18, 2011. Motion seconded by Mr. Strittmatter. Mr.
Kory absent. All in favor, motion carried (6-0). Mr. Rodgers noted a few
changes to the wording of the May 16,
2011 Council Meeting Minutes. A motion was made by Mr. Morgan to
approve the Council Meeting Minutes of May
16, 2011 with changes. Motion seconded by Mr. Strittmatter. Mr.
Kory absent. All in favor, motion carried (6-0). A motion was made by Mr.
Morgan to approve the Special Meeting Minutes of June 8, 2011. Motion seconded by Mr. Strittmatter. Mr.
Kory absent. All in favor, motion carried (6-0). A motion was made by Mr.
Morgan to approve the ratification of payroll from May 19, 2011 through June 20, 2011 in the amount of $15,310.56. Motion
seconded by Mr. Strittmatter. Roll call: Mr. Rodgers, Mr. Danyluk, Mr. Ewald,
Mr. Pile, Mr. Strittmatter and Mr. Morgan in favor. Mr. Kory absent. All in
favor, motion carried (6-0). A motion was made by Mr. Morgan to approve the
bills from May 18, 2011
through June 21, 2011 in
the amount of $50,951.54. Roll call: Mr. Rodgers, Mr. Danyluk, Mr. Ewald, Mr.
Pile, Mr. Strittmatter and Mr. Morgan in favor. Mr. Kory absent. All in favor,
motion carried (6-0). A motion was made by Mr. Pile to approve the May 2011
treasurer’s report in the amount of $597,208.77. Motion seconded by Mr.
Strittmatter. Mr. Kory absent. All in favor, motion carried. A motion was made
by Mr. Pile to note the receipt of the May 2011 tax collector’s report in the
amount of $2,913.90. Motion seconded by Mr. Strittmatter. Mr. Kory absent. All
in favor, motion carried (6-0).
Police Chief’s Report
Chief Havas reported the Officers
have completed the annual Firearms Qualifications. Chief Havas stated the
Officers had no major problems during the Southmont Jubilee. Police fines were
$176.72 for vehicle fines and $161.17 for Ordinance fines.
Fire Company’s Report
Chief Leckey absent. The Fire
Company report was not received. The Hilltop Ambulance Report was received and
is on file.
Engineer’s Report
Mr. Wargo reported The EADS Group
participated in a brief meeting held on June 16 with Mr. William Kcenich, a
representative of the Department of Environmental Protection Bureau of
Waterways Engineering, to investigate potential sources of funding for
resolving flooding of the Shady Lane
tributary to Cheney Run. Mr. Wargo reported EADS met with a representative of
Columbia Gas on April 14 and provided televising results showing defects to the
sanitary sewers noting Borough personnel are coordinating with Columbia Gas and
the Greater Johnstown Water Authority to repair those defects that are in
conflict with the gas mains and water lines.
Zoning Officer’s Report
Mr. Wargo reported one zoning
permit issued to 402 State Street
and one approved sewer compliance for 100 Susan Drive.
Mr. Wargo reported on an issue at 15 Shady Lane
regarding a deteriorating retaining wall noting a certified letter has been
sent to the property owner notifying him the wall must be repaired. Mr. Wargo
stated 26 property maintenance letters have been sent out to various residents.
Mayor’s Report
Nothing to report.
Manager’s Report
Mr. Wargo reported the Street
Department has begun the summer work schedule of 6
a.m. – 2 p.m. until September 5. Mr. Wargo stated the Laurel
Highlands Correctional Institution will be painting stop bars throughout
Southmont the week of June 20. Mr. Wargo reported a final draft of the new
Borough maps was received and is being reviewed.
Solicitor’s Report
Attorney Carbonara briefly
discussed a few issues regarding auditing services provided by Wessel &
Company and payment for the services noting a meeting will be scheduled to meet
with Wessel & Company to discuss the issues. Attorney Carbonara reported he
received a call from Attorney Robert Shahade regarding the sanitary sewer
agreement with Upper Yoder noting Attorney Shahade
requested to extend the terms of the agreement. Attorney Carbonara stated
Johnstown Redevelopment Authority held a meeting to discuss Ordinances and
pressure testing.
Secretary’s Report
Mrs. Czyrnik reported 2011 Fall
Brush Clean-Up has been scheduled for September 26, 27, and 28. Mrs. Czyrnik
reported the first payment from the State Police Fines and Penalties in the
amount of $1,235.16 has been received. Mrs. Czyrnik stated a copy of the new
Surety Bond for Atlantic Broadband with Fidelity & Deposit Surety Company
has been received in the amount of $100,000.00. Mrs. Czyrnik reported Fidelity
& Deposit Surety Company has notified the Borough that Central Tax Bureau
will cancel the surety bond from March 2007 noting the new bond from Travelers
Casualty and Surety Company has been received.
1) COMMITTEE REPORTS
A. Streets: Mr. Wargo reported paving is scheduled to begin June 21 with a completion date of June 30.
B. Administration: Nothing to report.
C. Personnel: Nothing to report.
D. Police Committee: Nothing to report.
E. Fire Company Committee: Nothing to report.
F. Budget & Tax Collection Committee: Nothing to report.
G. Shade Tree Committee: Mr. Wargo reported he and Mr. Morgan attended a Tree Care Workshop on June 7. Mr. Morgan reported hazardous trees have been removed including one at Diamond Boulevard Playground which was rotted at the bottom. Mr. Morgan stated there are plans to remove more hazardous trees.
H. Recreation Committee: Nothing to report.
I. Buildings & Grounds Committee: Nothing to report.
J. Greater Johnstown Water Authority: Mr. Pile reported the Department of Environmental Protection has requested a five year time frame to complete North Fork Dam repairs. Mr. Pile reported a 3-D seismic survey will be completed at North Fork Dam.
K. Open Records: One open records request was received from Ms. Lauren Birthisel for Ordinance No. 419 regarding raising chickens on private property in Southmont she was interested in purchasing.
There being no further business, a motion was made by Mr. Morgan for adjournment of the June 20, 2011 meeting at 8:22 P.M. Motion seconded by Mr. Pile. All in favor, motion carried.
